General Terms of Service

Murray Marketing Services offers a range of services to our valued customers ("you"), which encompass but are not limited to website development, website design, website hosting, website maintenance, Search Engine Optimization (SEO), graphic design, paid advertising, Google advertising, social media marketing, and other related services. These services collectively constitute the "Services."

By utilizing the Services provided by Murray Marketing Services, you, the Customer, agree to be bound by these Terms of Service, in addition to any other relevant policies or terms referenced or published by us (collectively referred to as the "Terms"). In the event that you do not agree to these Terms, it is imperative that you refrain from registering an account or engaging in the purchase, access, or utilization of Murray Marketing Services in any capacity.

These Terms serve as a legally binding agreement between Murray Marketing Services and any individual or organization that makes a purchase, accesses, or employs Murray Marketing Services ("Customer" or "You"). The Customer hereby represents, warrants, and affirms that (a) they possess the full authority and capacity to enter into and fulfill these Terms, or (b) if the Services are utilized on behalf of an organization, entity, or group, the person acting on their behalf is authorized to accept these Terms.

Financial Arrangements

• The Customer agrees to adhere to a thirty (30) day contract minimum, effective upon the commencement of the service. The exact contract duration will be determined during the sign-up process.
• The Customer assumes responsibility for all charges and fees associated with their account.
• AUTOMATIC RENEWAL: Following the conclusion of the contract term, the contract will automatically renew at the prevailing non-promotional rate for the original contract length, perpetually, until expressly cancelled.
• Murray Marketing Services will effect automatic renewal of the pertinent service during its renewal period and will process payment through the linked payment method associated with the account. Should any service not be slated for automatic renewal, you can opt to terminate that service. If you decide not to renew a service, it will terminate upon the expiration of the current term. You can manually renew the Services prior to that date. Services must be cancelled before their renewal date(s) to prevent automatic renewals. Renewal dates activate at midnight, Eastern Standard Time (EST).
• If the Customer's payment card is found to be expired, invalid, or unchargeable, Murray Marketing Services reserves the right to use other payment methods linked to the Customer's bank account, like new credit card details from the card issuer. If any non-refundable charges have already been accrued, these must be settled prior to the cancellation of the account.
• Service charges, fees, and service plans may be adjusted by Murray Marketing Servicesat any point, and such modifications will be duly communicated. Services involving outdated or unsupported features may incur supplementary maintenance fees. In such instances, Murray Marketing Services will provide advance notice to the Customer and grant them the option to cancel Services without incurring additional alteration fees, albeit without refund for any previously assessed fees.

Age

• You affirm and certify that you are at least 18 years old, or that you have obtained the necessary consent of your parent or legal guardian to execute this contract on your behalf.
  
  

Termination

• Either party may terminate this contract by providing a written notice with a 30-day notice period. Murray Marketing Services acknowledges termination by electronic mail. Notwithstanding the above, Murray Marketing Services reserves the right to terminate this contract at any time without penalty, in the event of your non-compliance with the terms outlined here, including instances of non-payment. A reinstatement fee may be charged. For website hosting, a longer written notice may be required. Please visit your specific service contract for up-to-date details of termination.
  
  

Limited Liability

• You expressly concur that your utilization of Murray Marketing Services is at your sole risk. Neither Murray Marketing Services, its employees, affiliates, agents, third-party information providers, licensers, nor any similar entities make any assurances that the services will be uninterrupted or error-free. Neither do they warrant the outcome that may arise from the use of the services or as to the precision, dependability, or content of any information, service, or merchandise supplied through Murray Marketing Services.
• Under no circumstances, including negligence, shall Murray Marketing Services, its officers, agents, or any other entities involved in the creation, production, or distribution of Murray Marketing Services' services be held liable for any direct, indirect, incidental, special, or consequential damages arising from your use or inability to use the services.
• Despite the foregoing, your exclusive remedies and Murray Marketing Services' overall liability for all damages, losses, and causes of action, whether in contract, tort, or otherwise, arising from these Terms or from the use or inability to use the Services, shall not exceed the aggregate amount you paid to Murray Marketing Services within the three (3) months immediately preceding the claim.

Indemnification

• You agree to defend, indemnify, save, and hold Murray Marketing Services harmless from any and all demands, liabilities, losses, costs, and claims, including reasonable attorney fees, that may be asserted against Murray Marketing Services, its agents, its customers, servants, officers, and employees, arising out of any service provided or performed or agreed to be performed, or any product sold by you, your agents, employees, or assigns.

Sanctioned Countries

• You agree to adhere to all applicable export and re-export control laws and regulations, including the Export Administration Regulations ("EAR") maintained by the U.S. Department of Commerce, trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control, and the International Traffic in Arms Regulations ("ITAR") maintained by the Department of State.
• Specifically, you covenant not to – directly or indirectly – sell, export, re-export, transfer, divert, or otherwise dispose of any products, software, or technology (including products derived from or based on such technology) received from Murray Marketing Services under this Agreement to any destination, entity, or person prohibited by the laws or regulations of the United States, without obtaining prior authorization from the competent government authorities as required by those laws and regulations. You agree to indemnify Murray Marketing Services from any fines or penalties arising from your breach of this provision. This export control clause shall continue to apply even after the termination or cancellation of this Agreement.

• You also acknowledge that you will comply with all applicable terms set forth by all Murray Marketing Services partners and subsidiaries.

Contract Revisions

• As Murray Marketing Services evolves, modifications to these Terms may occur to reflect changes in the business. Such modifications may involve discontinuation of outdated products or services, additional fees, and changes to policies, among other aspects. Notice of updates, including but not limited to statements on the website, newsletters, or email notifications, may be provided. However, you are responsible for regularly checking the current version of the Terms by visiting this page (and other pages referenced herein).
• If you continue to access or use the Services after the effective date of such modifications, you agree to be bound by the revised Terms, as well as all other terms and policies incorporated herein, whether directly or by reference.

Transfer

• You may not assign or transfer your rights or obligations under these Terms without the written consent of Murray Marketing Services.

Governing Law

• The Terms and the resolution of any disputes shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of laws principles.

These Terms of Service constitute the agreement between Murray Marketing Services and its customers. By purchasing, accessing, or using Murray Marketing Services' offerings, you signify your acceptance of these terms. If you do not agree to these terms, you must not register an account or access Murray Marketing Services' offerings.
